Welcome to UNITS Moving and Portable Storage — Sacramento (“UNITS Sacramento”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website located at https://www.unitssacramento.com (the “Site”) and the portable-storage and moving services we provide (collectively, the “Services”). By accessing the Site or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site or Services.

2. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site (a) in any way that violates any applicable federal, state, local, or international law or regulation; (b) to transmit or procure the sending of any advertising or promotional material, including any “junk mail”, “chain letter”, or “spam”; (c) to impersonate or attempt to impersonate UNITS Sacramento, an employee, another user, or any other person or entity; or (d) to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site.

3. Services and Estimates

Quotes and estimates for portable-storage and moving services are provided for informational purposes. All Services are subject to a separate written rental or service agreement between you and UNITS Sacramento, which will govern the specific terms of your rental, including pricing, delivery, pickup, access, and liability.

4. Reservations, Cancellations, and Payments

Reservations made through the Site or by phone are subject to availability and confirmation. Cancellation policies, deposit requirements, and payment terms will be disclosed at the time of booking and are set forth in your rental or service agreement. You are responsible for providing accurate billing information and for all charges incurred under your account.

5. Your Stored Contents; Prohibited Items

You are solely responsible for the items you place in any UNITS container. You may not store hazardous, flammable, explosive, perishable, illegal, or living items. A complete list of prohibited items is provided at booking and in your rental agreement. UNITS Sacramento is not responsible for loss or damage to prohibited items or to items you fail to properly pack and protect.

6. Access and Delivery

You are responsible for ensuring that the delivery location is legal, safe, accessible, and has sufficient overhead clearance and a firm, level surface. You are responsible for obtaining any permits, homeowners-association approvals, or other permissions required for placement. UNITS Sacramento may refuse delivery or pickup if conditions are unsafe.

7. Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by UNITS Sacramento, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual-property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Site without our prior written consent.

8. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by UNITS Sacramento. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that UNITS Sacramento shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

9. Disclaimers

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, UNITS SACRAMENTO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL UNITS SACRAMENTO, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE OR SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Any liability arising from the physical moving and storage Services will be governed by your separate written rental agreement with UNITS Sacramento.

11. Indemnification

You agree to defend, indemnify, and hold harmless UNITS Sacramento, its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including but not limited to any use of the Site’s content, services, and products other than as expressly authorized in these Terms.

12. Governing Law and Venue

These Terms and any dispute or claim arising out of or related to them or the Site shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. You agree that any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Yolo County or Sacramento County, California, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
